Terms of Service
These Terms of Service (the “Terms”) govern access to and use of Rally Club, a tournament-management service for pickleball clubs, organizers, teams, and participants (the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who operates Rally Club
The Service is operated by Orvry Apps (“Rally Club,” “we,” “us,” or “our”). Contact details are provided in Section 14. Replace all highlighted placeholders and verify the operator details before publication.
2. The Service
Rally Club may provide tools to create tournaments, manage clubs and participant lists, organize teams, schedule courts and matches, record and publish scores, maintain brackets, and communicate event information. Features may change over time. The Service is a management tool; it does not replace the organizer’s judgment, event rules, or official governing-body rules.
3. Accounts and eligibility
- Provide accurate, current account information and keep it updated.
- Keep your credentials confidential and notify us promptly of suspected unauthorized access.
- You are responsible for activity carried out through your account, except to the extent caused by our failure to meet obligations imposed by applicable law.
- You may use organizer features only if you can legally agree to these Terms. Where a participant is a minor, the organizer must follow applicable age, guardian-notice, and consent requirements.
4. Clubs, organizers, and participant information
If you create a club or tournament, you are responsible for the information you submit, the permissions you grant to staff, and the accuracy of schedules, rosters, and results. You must have an appropriate basis and authority to submit personal information about players, team members, guardians, or other participants, and to provide required notices. Do not submit information that is unnecessary for organizing the event.
Organizer settings may determine whether tournament names, player/team names, match schedules, brackets, and scores are visible to other users or the public. Review visibility settings before publishing event information.
5. Acceptable use
You must not use the Service unlawfully; infringe another person’s rights; upload malicious code; interfere with or disrupt the Service; attempt unauthorized access; falsify scores or records; misuse other users’ information; or use the Service to harass, defraud, or mislead others. We may investigate suspected abuse and take proportionate action where permitted by law.
6. Scores, schedules, and event decisions
Organizers are responsible for confirming match rules, scores, court assignments, results, and corrections. We may provide validation, audit history, and conflict warnings, but these features may not identify every mistake. Do not rely on the Service as the sole source for safety-critical event decisions. If a result appears incorrect, use the organizer’s correction process and retain any relevant event records.
7. Your content and our intellectual property
You retain rights you have in content you submit. You grant us a limited, non-exclusive permission to host, process, display, and transmit that content as reasonably necessary to operate, secure, and improve the Service and to provide the features you request. You confirm you have the rights and permissions needed for that use. Rally Club’s software, branding, design, and documentation are owned by or licensed to the operator and may not be copied or redistributed except as allowed by law or with written permission.
8. Third-party services
The Service may rely on third-party infrastructure or link to external services. Those services may have separate terms and privacy notices. We are not responsible for third-party services to the extent permitted by applicable law. Current infrastructure providers and relevant data handling are described in the Privacy Policy.
9. Availability and changes
We aim to keep the Service reliable, but we do not promise uninterrupted or error-free operation. Maintenance, outages, network issues, or changes to third-party services may affect availability. We may update, suspend, or discontinue features. Where reasonably practicable, we will provide notice of material changes.
10. Suspension and termination
You may stop using the Service at any time. We may restrict or suspend access when reasonably necessary to protect users, investigate suspected abuse, comply with law, address security risks, or enforce these Terms. Where appropriate and lawful, we will provide notice and an opportunity to address the issue. Data deletion and retention are governed by the Privacy Policy and applicable law.
11. Disclaimers
To the maximum extent permitted by applicable law, the Service is provided on an “as available” basis. We do not guarantee that it will always be available, secure, accurate, or suitable for every event. Nothing in these Terms excludes or limits a right or remedy that cannot lawfully be excluded or limited.
12. Limitation of liability
To the maximum extent permitted by applicable law, the operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or for loss of profits, goodwill, or data arising from use of the Service. Nothing in this section limits liability that cannot be limited under applicable law. Before launch, the operator should obtain advice on the wording and any required consumer-protection disclosures for its jurisdiction.
13. Changes to these Terms and governing law
We may update these Terms by posting a revised version with a new “Last updated” date. If a change is material, we will provide notice where required. Continued use after the effective date constitutes acceptance only to the extent recognized by applicable law. These Terms are subject to mandatory laws that apply to you.
